David v. Goliath: Harnessing the Power of Artificial Intelligence in International Arbitration

On 26 October 2024, Anastasiya Ugale took part in a thought-provoking panel at the American Branch of the International Law Association's 2024 International Law Weekend conference in New York City. The panel, aptly titled "David v. Goliath: Harnessing the Power of Artificial Intelligence in International Arbitration," brought together a diverse group of experts to explore the potential of AI in leveling the playing field in international arbitration.

Moderated by Joseph Choe, the panel featured Ugale alongside renowned arbitration practitioners Sophie Nappert, Benjamin I. Malek, and Oliver Roberts.

The discussion delved into the ways AI could potentially bridge the resource gap between smaller and larger parties in arbitration proceedings. Ugale shared insights on how AI tools could assist less-resourced parties in document review, legal research, and case strategy development. She emphasized that while AI has the potential to enhance efficiency and reduce costs, the current advantages it provides to smaller practitioners are short-lived. The panel explored various AI applications in arbitration, from predictive analytics to automated document review and even AI-assisted drafting of submissions. They also addressed concerns about data privacy, algorithmic bias, and the need for transparency in AI-driven processes.

The panel and the attendees were divided on whether AI could truly serve as an equalizing force in the long term. Some expressed optimism about AI's potential to democratize access to sophisticated legal tools, while others voiced concerns about the technology potentially widening the gap between those who can afford cutting-edge AI solutions and those who cannot. The lively debate highlighted the complex interplay between technological advancement and the fundamental principles of fairness and equality in international arbitration. As AI continues to evolve, it's clear that the arbitration community will need to grapple with both its promises and pitfalls in the quest for a more level playing field.
